Terms of Service

These Terms govern access to Helvstack services provided by Elyze Solutions Sàrl (“Elyze”, “we”, “us”). By creating an account, accepting an order, or using Helvstack, you agree to these Terms. If you use Helvstack for an organization, you confirm that you may bind that organization.

The service

Helvstack provides deployment, runtime, configuration, observability, backup, and related control-plane capabilities. Features, quotas, regions, support levels, and prices are those shown in your order or current plan. Preview and beta features may change or be withdrawn and are provided without a production service level.

Your responsibilities

You are responsible for your accounts, authorized users, source code, workloads, data, domains, credentials, configuration, and lawful use. Keep credentials secure, grant least-privilege access, review deployment plans, and maintain any backups your risk profile requires. Notify us promptly of suspected unauthorized access.

Acceptable use

You may not use Helvstack to violate law or third-party rights; distribute malware; conduct unauthorized access, scanning, abuse, or denial-of-service activity; evade sanctions or export controls; interfere with the service; or expose content that creates material security or operational risk. We may limit or suspend activity needed to protect users, the platform, or third parties.

Fees and taxes

Paid plans are billed as stated at checkout or in an order. Fees are due in the stated currency and exclude taxes unless indicated otherwise. Usage beyond a plan allowance may be blocked or charged at the disclosed rate. We may change future pricing with reasonable notice; changes do not retroactively alter a committed order period.

Customer content and licence

You retain ownership of your content. You grant us the limited rights needed to host, copy, transmit, build, deploy, back up, restore, and otherwise process it to provide and secure Helvstack. You represent that you have the rights needed for content and instructions you submit. Helvstack, its software, marks, and documentation remain owned by Elyze and its licensors.

Confidentiality and data

Each party will protect the other's non-public confidential information and use it only for the relationship. Our handling of personal data is described in the Privacy Policy. Additional data processing terms or service levels apply only when agreed in writing.

Availability, changes, and suspension

We work to operate Helvstack reliably but do not promise uninterrupted or error-free service unless an executed agreement says otherwise. We may perform maintenance, change the service, or suspend access for security, non-payment, legal requirements, or material breach. Where practical, we will provide notice and a path to cure.

Termination

You may stop using Helvstack at any time and may cancel a subscription under its plan terms. Either party may terminate for material breach that is not cured within a reasonable notice period, or immediately where law or security requires. On termination, access ends and data may be deleted after the applicable export and retention period. Accrued payment obligations and terms that by nature should survive will survive.

Warranties and liability

To the extent permitted by law, Helvstack is provided “as is” except for express commitments in an executed agreement. Neither party is liable for indirect, incidental, special, punitive, or consequential loss, or lost profits, revenues, or data. Elyze's aggregate liability arising from the service is limited to fees paid for the affected service during the twelve months before the event, except where liability cannot legally be limited.

Governing law and contact

Swiss law governs these Terms, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Courts at Elyze's registered seat have exclusive jurisdiction, subject to mandatory consumer protections. Questions can be sent to contact@elyzesolutions.ch.
